Subject: REPORT OF THE TEAM OF INTERNATIONAL EXPERTS IN THE DRC (A/HRC/51/60)
The Congolese Society for the Rule of Law has analyzed the Report of the Team of International Experts presented during the fifty-first sessions of the Human Rights Council on technical assistance in the DRC.
The SCED supports the recommendations relating to the implementation of Transitional Justice and the fight against impunity.
With regard to Transitional Justice, while welcoming the adoption by the Central Government of the draft law establishing the fundamental principles relating to the protection and reparation of victims of sexual violence linked to armed conflict and other crimes against the peace and security of humanity, she urges Congolese civil society to mobilize during the adoption of this bill in parliament so that the whole policy of reparation is not concentrated in the hands of the Government, which would pose a serious threat to the independence of implementing institutions. The call for mobilization is also justified to invite the parliament to redouble its efforts, in order to ensure the financing by the national budget of transitional justice initiatives.
With regard to the fight against impunity, the SCED deplores with the Team of International Experts, the slowness of the prosecution of the perpetrators of serious crimes committed in the Kasai region and in the eastern part of the country. It supports the urgency of an appropriate communication policy, in order to make visible the Government’s efforts in the fight against impunity.
It encourages the Government of the Republic to revise the system of immunities which constitute a real obstacle to the fight against impunity.
